Two or more prior DWI convictions - A DWI is a third degree felony if it is shown at trial that you have two or more prior convictions for DWI; it doesn't matter how long ago the prior convictions happened.

Sec. 49.045.  DRIVING WHILE INTOXICATED WITH CHILD PASSENGER.  (a)  A person commits an offense if:

(1)  the person is intoxicated while operating a motor vehicle in a public place; and

(2)  the vehicle being operated by the person is occupied by a passenger who is younger than 15 years of age.

(b)  An offense under this section is a state jail felony.

What are the Penalties For a Felony DWI?

Below are some of the penalties you can expect for a felony DWI:

    State Jail Felony

    • 180 days to 2 years in Texas penitentiary
    • Fines of up to $10,000
    • Driver's license surcharge ($1000 per year for 3 years on first offense, $1500 per year on subsequent offenses)

    3rd Degree Felony DWI Offense:

    • 2-10 years in Texas penitentiary
    • Fines of up to $10,000
    • A surcharge of $1500 per year for 3 years (in addition to any prior surcharges)
    • A surcharge of $2000 per year if your BAC is .16% or higher
    • Driver's license suspension for 180 days to 2 years
    • Mandatory 32 hour DWI Repeat Offender Program
    • Mandatory ignition interlock device (if prior is less than 5 years old)
    • Possible Probation
